Terms of Service

These Terms govern your use of Evarist, a product operated by Wisepops ("Evarist", "we", "us"). By creating an account or connecting Evarist to an AI client, you agree to them.

1. Your account

You are responsible for the activity under your account and for keeping your sign-in and connection credentials secure. When you set up Evarist on a website, we mint a site identifier for that site so your analytics stay scoped to you.

2. Acceptable use

You may use Evarist only for lawful purposes and only on websites you own or are authorised to instrument. You must not:

• deploy the Evarist tracker on websites directed to children, or knowingly use it to collect personal data from children below the applicable age of digital consent;
• attempt to re-identify, or combine our data to single out, individual visitors;
• collect special-category data (e.g. health, religion, precise location) through the tracker, or place the snippet on pages where such data would be captured;
• interfere with, probe, or attempt to circumvent the security or tenant isolation of the service.

3. Your role — you are the controller

For personal data collected from visitors to your website via the Evarist tracker, you are the data controller and Evarist (Wisepops) acts as your processor. You warrant that you have a valid legal basis and have obtained any consent required by applicable law (including ePrivacy / cookie rules) before the tracker runs on your site.

4. Data Processing Agreement

Our Data Processing Agreement is incorporated into and forms part of these Terms and applies whenever we process visitor personal data on your behalf.

5. The service

Evarist is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude implied warranties and our aggregate liability is limited to the fees you paid for the service in the preceding twelve months (or, for a free plan, is excluded to the extent the law allows). Nothing limits liability that cannot be limited by law.

6. Termination

You may stop using Evarist and delete your account at any time; deletion removes your account, your sites, and your access (see the Privacy Policy for how already-collected visitor analytics are handled). We may suspend or terminate access for breach of these Terms.

7. Changes & governing law

We may update these Terms; for material changes we will ask you to accept the updated version at your next sign-in. These Terms are governed by French law, and the competent French courts have jurisdiction, without prejudice to mandatory consumer-protection rules of your country of residence.
